The services described in this website are provided by Tender Soft Ltd, a company registered in England & Wales at Companies House Cardiff on 31 March 1995, registration number 3040700 - for the benefit of "you", the customer of the services.
Web Design
- You may alter and build on any website we create for you, and may re-use the design when adding new pages to your site, but you may not reproduce the design to create new websites, nor separately resell any elements of the design. You may only sell your site in whole part, passing on all respective rights and obligations to the buyer and relinquishing all rights under these Terms.
- All design material provided by us remains the property of Tender Soft Ltd (with sub-elements owned by our licensors) and may be used by you under licence according to these Terms. For example, you do not assume the ownership of library pictures when we add them to your site, you merely acquire a non-exclusive right to make use of them within your site.
- You are not required to obtain any further services from us in order to continue to use your site and may transfer your site to another host, provided that you continue to adhere to these Terms where applicable.
- We provide you with tools enabling you to make considerable changes to your site, within the constricts of your original design. You are free to add any legal content you desire and we will not require you to included any unwanted content (such as third party advertising) unless we reasonably hold that such content is required by law.
Web Hosting
- Web hosting is the service that maintains your website on the Internet 24 hours a day to be viewed and used by visitors around the world. We provide a number of other services included under the "hosting" label, including an online edit facility to allow you to update your website from any connected PC without requiring any web skills.
- Hosting is subject to periodic renewal, and may be terminated when a due payment has not been made.
- We provide you with a monthly transfer quota (starting at 2GB, enough for up to a million hits a year) from servers connected to the Internet at 100Mbit/s as standard, housed in high-security data-centres staffed 24 hours every day. In the unlikely event that you require even more throughput, we may need to increase your charges proportionately or work with you to find another solution such as advertising.
Service Renewals
- Domain name ownership and website hosting will be subject to renewal whenever the current period of service, whether paid for or not, expires. It is not always possible to provide a "grace period" of service after expiration. Sometimes, email reminders may not reach their destination. Therefore it is important that the customer shares responsibility for ensuring that services are renewed on time, in order to avoid any possible loss of service.
- When a service has been lost due to non-renewal, it is generally possible to re-start it, within hours, at any point during the next 30 days. After that point, it may not be possible or, if it is, it may involve extra charges. Some of these charges are outside our control and may be considerable (£200 for recovering a de-registered domain).
Domain Name Registration
- Domains names registered on your behalf are issued in your name. It is therefore important that the contact details you provide are correct, since incorrect details could result in further expense or the loss of a registration. A charge of around £15 will typically be made to record significant changes to a domain's ownership record.
- Domains are issued by their respective top-level domain authority, and are held in accordance with that registry's own terms and conditions.
- Most domains are issued by their the registry for one year, after which they may be renewed on generally the same or similar terms. Domains ending in ".uk" are registered for two-year periods.
- Domain ownership is a separate service from website hosting and it is not necessary to maintain both with Tender Soft Ltd. We will repoint a domain held with us to another hosting service by means of resetting its DNS A-Record at the customer's request at no charge. We will allow the customer to transfer their domain to an alternative registration agent at no charge. In both instances, it will be necessary to complete a process to determine the authenticity of the customer's request (which may be impeded if the customer has provided incorrect or out-of-date contact information).
Pricing and Refunds
- For projects under £500, work will begin once full payment has been received. For larger projects, a schedule of interim delivery and fees will be agreed.
- Please note that web design and any domain names ordered are "personalized goods" and any advance fees paid cannot generally be refunded. However, your domains will remain under your control for the period of registration (one or two years) and they may be renewed at the standard rate or freely transferred to another registration agent.
- Where services are provided with a satisfaction-guaranteed refund period, any refund must be claimed during the last seven days of that period. For example, if you are offered a 28-day money-back guarantee, you must claim any refund during the fourth week.
- Refunds will in all events be limited to the amount paid for the current period of service, and no further liability can be accepted for non-performance or failures of service.
